S. government violated Salvadoran asylum seekers’ privacy—with potentially fatal consequences—by sharing information about them with the government they were fleeing, and to which the United States itself acknowledged most of them would be returned. We know this because of materials provided a 30 SEPTEMBER 11 decade after the fact to Robert Kahn in response to his FOIA requests. S. 24 INS officials told Malone that their privacy policy was consistent with Federal Bureau of Prisons guidelines.

The FOIA specialist also said that Chief Press Officer Bergeron denied the existence of the document he had mentioned to Malone. When Malone tried to help out with the search by letting the FOIA specialist know that Bergeron had identified one Kristine Marcy as an INS field officer knowledgeable on the subject, the FOIA specialist responded that she was unable to locate any such INS employee. Malone then called the INS switchboard, which gave him Marcy’s number. The INS continued its refusal to provide the requested information on the grounds that it was protecting the detainees’ privacy.

In refusing to lift the restrictions, Quarantillo wrote: “You sought to obtain information from an INS employee (whom you clearly knew was not the Public Affairs Officer) that the Attorney General has determined is relevant to the investigation of the events of September 11 and not appropriate for release at this time. . ”33 Several weeks earlier Quarantillo had decided not to attend a public meeting set up by immigrant advocacy groups to discuss September 11 detentions with the disrupted communities because the organizers refused to comply with the INS condition that journalists be forbidden from participating.
